Joyce Jones did not listen to any advice you gave her with respect to the covenant not to compete! She added the covenant to her employment contract exactly as she had previously described to you, except she modified the length of the covenant to five years.

Mark Benz became employed as a stylist at “Beautifully Natural” on May 3, 2021. At the time that Joyce Jones hired him, she gave him the employment contract and advised him to read it thoroughly, obtain the advice of counsel, if necessary, and sign the agreement and return it to her prior to beginning work. Mark Benz read the agreement in its entirety. Although he didn’t like the restrictive covenant, he decided to sign the agreement because he really liked Joyce Jones and was anxious to work in such a prestigious salon.

He immediately began his individualized training with Joyce Jones, learning how to mix and apply her products to customers of the salon. On October 8, 2021, Mark Benz resigned from his position at Beautifully Natural, so that he could work at another salon closer to his home in Winter Haven, Florida. He was tired of driving all the way to Altamonte Springs every day and didn’t particularly like some of the other stylists at Beautifully Natural.

Joyce Jones was outraged that Mark Benz quit just a few weeks short of completing his training program at her salon. She decided to file a Motion for Injunctive Relief, prohibiting Mark Benz from opening or working in another beauty salon in Orange, Osceola, Seminole, and Polk counties for a period of five (5) years, as set forth in the employment agreement.
